Both the use and all purchases made in our online shop jaleadeluz.com, are subject to these general conditions of contract, set out in this document, which shall be deemed accepted by the mere exercise of the purchase. The sales are distance sales regulated by the Spanish legislation in force on the matter. For the acquisition of the products offered in jaleadeluz.com, users must be over eighteen (18) years and have legal capacity to enter into binding contracts. For verification we reserve the right to carry out as many steps and requests to send information as necessary to perform such verification.

Jalea de Luz, S.L. is a limited company of Spanish nationality, whose object is the purchase and sale of food products, cosmetics and gift items by electronic, telephonic, telematic and face-to-face means. Hereinafter, we will refer to our company as the ‘company’.

CONTENTS AND INFORMATION PROVIDED

Jalea de Luz establishes a series of processes carried out by our team of professionals together with our technology, to offer all the information contained in our website in a clear and truthful way.

Jalea de Luz reserves the right to modify the commercial offer presented on our website (modifications on products, prices, promotions and other commercial and service conditions) at any time.

In the event that at any time there is an error of any kind, at all times beyond our control, we will proceed immediately to correct it. If there is a typographical error in any of the prices shown or in the characteristics of the product, and a customer has made a purchase decision based on that error, Jalea de Luz will inform the customer of the error and the customer will be entitled to cancel the purchase without any cost on their part.

Jalea de Luz is not responsible either directly or indirectly for any of the information, content, statements and expressions contained in the products we sell.

PRICE LIST AND APPLICABLE TAXES

All retail prices of our products include VAT.

At the end of the purchase, when validating the cart, you will see the amount of the same broken down. All the selling prices of our products include the VAT (value added tax) applicable in each case, but do not include shipping costs, which are calculated in the shopping cart detail according to the total weight of the order and the destination to which it is sent.

In the shopping cart detail, the customer can see a breakdown of the total amount of the products to be purchased, in another line the amount of the shipping costs and then the total amount of the purchase, which in brackets is broken down by the amount of each of the VAT rates that they contain.

You will see the purchase made, as will be reflected in the order confirmation that the system automatically sends you at the end of the purchase process.

Purchases made by individuals domiciled in any of the member states of the European Union will be subject to VAT. Purchases made by companies or VAT taxable persons, established in any of the member states of the European Union, will be exempt from VAT.

The prices of the products we sell on jaleadeluz-gourmet.com may be revised and modified without prior notice if circumstances so require at any time.

PAYMENT METHODS

By credit card

At Jalea de Luz, we guarantee that every transaction you make with us is 100% secure. All transactions involving the transmission of personal or bank details are carried out using a secure environment. Jalea de Luz uses Shopify technology and payments are protected by Shopify Payments.

This payment method does not incur any fees or commissions.

When you start the last step of the purchase process having chosen to pay by credit card, we connect you via a secure connection directly to the sales terminal of the financial institution, from where you will enter your card details and validate it. Subsequently the bank indicates whether the operation is in accordance and automatically our system will begin to process your order.

Jalea de Luz does not register this information in its database as it has no access to it.

The data concerning your credit card number is only recorded by the financial institutions we work with. Jalea de Luz S.L. does not register this information at any time.

In certain cases and to prevent possible incidents, Jalea de Luz S.L. reserves the right to ask a customer for a specific form of payment in the event that the identity of the purchaser is not reliably accredited.

SHIPPING

Shipping costs are calculated automatically from our online shop, depending on weight, country, postal code, and can be seen automatically in the detail of the cart.

Jalea de Luz sends orders to its customers through different transport providers of national and international prestige. The delivery date at the customer's home depends on the availability of the chosen product and the selected carrier.

Before confirming your order, you will be informed of the shipping cost and transport times (both indicative), which will be applied to your order. However, both may vary depending on the specific circumstances of each order.

Transport times may be altered due to extraordinary incidents with the carrier and difficulties in the delivery of the goods. In the event of a price variation, Jalea de Luz will notify the customer by e-mail of the variation and the customer may choose to cancel their order without any additional cost being charged.

Delivery methods

1. Collection from our warehouses located in calle del Rey Católico s/n, in Monegrillo, Zaragoza.

2. National Post 24/48 hours: with the national transport service of Correos 24/48 hours, the delivery is generally made before 18:00 hours the day after having confirmed the order, in any provincial capital and maximum 48 hours in the rest of the towns.

3. International Land Transport Europe (3 to 10 days): With the International Land Transport Europe service, we will make International deliveries exclusively for international orders. Delivery is made during general office hours.

STOCK AND AVAILABILITY POLICY

Jalea de Luz guarantees its customers the availability of all products, except those in which it is reported that there is no stock because they are out of stock, until its replacement.

In the unlikely event that, due to circumstances beyond our control, there is no stock of any product you have purchased, we will proceed immediately to inform you, so that you can decide whether you want us to send you the rest of the order or you prefer to cancel it. If you decide that we send you the rest of the order, our sales team will proceed to cancel the previous order and create the new order. If you have paid for the order by credit card, we will automatically credit your credit card for the corresponding part of the order.

We only sell through our shop, those products that we can supply to guarantee your satisfaction.

RETURNS, CANCELLATIONS AND EXCHANGES

At Jalea de Luz, our main objective is to ensure the satisfaction of all our customers.

For this reason, we work to ensure that all our products reach you in perfect condition at your destination, through a fast and efficient delivery service within 24/48 hours.

1. Damage or error

In the event that the shipment is damaged by transport or does not correspond to what you have purchased, you must contact us within a maximum period of 14 days from receipt of the goods to manage the return and subsequent exchange.

Once received and checked all your information, Jalea de Luz will manage it and once confirmed by us, we will proceed to send you the product(s) causing the incident.

In this case, the handling and transport costs will be borne by us and will not entail any cost for you.

When you receive your order, before signing the delivery note of the carrier, you must check that all the boxes you receive do not have any anomaly of blow or breakage. If there are any, we recommend that you write these anomalies on the delivery note that you are given to sign and take photographs of the damage to send them to us.

To request this refund, you will have to contact us by sending an email to info@jaleadeluz.com.

2. Cancellation

If for any reason you are not satisfied with your purchase, you can return your order within 14 calendar days of receipt thereof, without any penalty and without stating the reasons.

‘Jalea de Luz ® , recognizes the CONTRACTOR the right of withdrawal under the terms and deadlines recognized in the Royal Legislative Decree 1/2007 of 16 November, which approves the revised text of the General Law for the Defence of Consumers and Users and other complementary laws such as Law 3/2014 of 27 March, in which case Jalea de Luz ® will refund the CONTRACTOR the amount paid as price and applicable taxes, to the account number indicated by the CONTRACTOR. The CONTRACTOR has a period, to exercise the right, of 14 calendar days from receipt of the product, being considered as such date, unless proven otherwise, the date indicated on the delivery document signed by the CONTRACTOR. ’

Once received and after checking that everything is in perfect condition, we will refund the full amount of your purchase.

Jalea de Luz will not assume in any case the cost of returning products.

It is essential that you return the order in perfect condition as you received it.

Given the nature of the products we sell, it is essential that all products are in perfect condition. This includes accessories, instructions and packaging.

If this is not the case (product manipulated, opened, broken, damaged labels...) we will not accept the return.

To exercise your right of withdrawal you must fill in the following withdrawal form and send it to us by email.

CUSTOMER OBLIGATIONS

The customer of Jalea de Luz undertakes at all times to provide truthful information about the data requested in the registration forms that identify the buyer and shipping and billing addresses, as well as to keep them updated at all times.

Jalea de Luz will consider as a customer or consumer to the one who enters their data correctly, truthfully or in good faith, so that the entry of false data, in addition to carrying the consequences provided by law (Penal Code, Articles 248, 255, 387, 392, 395, 623), implies for the principal the loss of consumer status and the benefits provided for consumers.

The customer undertakes to accept all the provisions and conditions contained in these General Conditions of Purchase on the understanding that they reflect the best possible service for the type of activity that we carry out.

Likewise, he/she undertakes to keep his/her personal access codes to our website confidential and with the utmost diligence.

The customer undertakes, in the event that the delivery method is home delivery, to enable the delivery of the requested order by providing a delivery address where it can be delivered within the normal delivery timetable (Monday to Friday from 9:00 to 13:30 and from 16:00 to 18:00).

In case of non-compliance by the customer of this obligation, Jalea de Luz will have no responsibility for the delay or impossibility of delivery of the order requested by the customer.
